  1. Scope of this Policy

Thank you for visiting Rhythmic Rebellion (henceforth sometimes referred to as “us”, “our”, “we”, or “Rhythmic Rebellion”), part of Patron Empowerment INC.  Rhythmic Rebellion is committed to respecting your privacy rights, whether on our website (the “Site”), our artist websites (“Artist Sites”), or through our mobile application (the “App”), collectively the “Platform”).  By accessing the Site, downloading our App, or using our Platform, you consent to Rhythmic Rebellion’s collection, use, storage, deletion and disclosure of information relating to you as set forth in this Privacy Policy.  This Privacy Policy is effective as of the date set forth above and is only applicable to the Platform and not to any other website that you may be able to access from the Platforms which may have its own data collection and use practices and policies.

  1. Information We Collect

We collect two types of information: Identifying Information and Non-Identifying Information.

Types of Identifying Personal Information We Collect

Personal information means information that can be used to identify and contact you. You do not need to submit personal information to access the Platform generally. However, you may be required to submit personal information to access certain aspects of the Platform. We may also collect non-personal information such as your browser type and when and from what location you access the Platform. This information may be aggregated to measure the number of visits, average time spent, page views, and other statistics about users of the Platform. We also may use this data to monitor the Platform’s performance and to make the Platform easier and more convenient to use.

When you create an account or when you enter information, we may collect personal information from you including:

  • First and last name
  • Email address
  • Phone number
  • Shipping and billing addresses
  • Purchase history
  • Account name and password
  • Age
  • Gender
  • Any photos you upload to your profile
  • Location information
  • When you complete any forms, respond to a survey or questionnaire, or participate in a contest, we collect the personal data you provide
  • Inference information, such as information about your interests and preferences    

A Note About User Content

We may allow you to post Content to our website, including videos and music. This content, once posted, is available for anyone to see and you are granting us the limited license for our use in accordance with our  https://rhythmic-creators.com/policies/creative-suppliment. As such, you must make sure you do not post anything that you do not have the rights to distribute.

Types of Non-Identifying Information We Collect

We may also collect general information resulting from your use of the Platforms, including your preferences and other tendencies. This may include anonymous “traffic data” or tracking information provided by the website’s host or similar provider of such information (i.e., Google Analytics) that does not personally identify you, but may be helpful for marketing purposes or for improving the services we offer. Analytics is the process of collecting, analyzing, and reporting aggregate data. This information may include which pages visitors visit, how long visitors may stay on a particular page, and where visitors are located. It may also provide information about what browser, network, or device is used to visit our Site.

        

In addition, when you use our Site, we may also log your anonymous IP addresses, a unique identifier for your computer or other access device. This helps us diagnose problems with our server, to administer our Site, or to display the content according to your preferences.

Analytics

We use third-party service providers such as Google Analytics and Hotjar to help us learn about who visits the Site and what pages are being viewed. Cookies

“Cookies” are small bits of electronic information that a website sends to a visitor’s browser and are stored on the visitor’s hard drive. Like many websites, we employ cookies in certain areas of the Site to allow us to provide information to make your online experience more convenient. For example, when you return to the Site after logging in, cookies provide information to the Site so that the Site will remember who you are on subsequent visits, speeding up or enhancing your experience of the Platform by, for instance, tailoring content to you. Cookies may also be used to keep track of your login name and password. While Rhythmic Rebellion may use cookies to track your visit to the Site, this information does not identify you personally and you remain anonymous, even if you have previously submitted personal information to Rhythmic Rebellion through the Site or otherwise. You may still access the Platform if you set your browser not to accept cookies.

Third parties whose websites are accessible through links on the Site may also use their own cookies when you link to their site or service. Rhythmic Rebellion does not control these third parties’ use of cookies and cannot guarantee that they will uphold the same privacy standards as Rhythmic Rebellion. Rhythmic Rebellion expressly disclaims any and all liability related to the collection, use or disclosure of information by third parties. You should review the privacy policies of any third-party websites that you visit through a link from the Site to understand how these third parties use cookies and the information they collect through cookies. Most cookies are “session cookies” which means that they are automatically deleted at the end of each session. Most browsers are initially set to accept cookies. You can set your browser to notify you when you receive a cookie, giving you a chance to decide whether or not to accept it.

Log Information

Our servers automatically record information that your browser sends whenever you visit the Site. This information includes your Internet Protocol address, your browser type and version, the search engine you used to find the Platform, if any, which aspects of the Platform you use and from where, and when and how long you use them. We use this information to monitor and analyze how users use the Platform, to provide customer service and to maintain and improve the Platform. We may also collect similar information from emails we may send to you which then help us track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Platform.

Do Not Track

Rhythmic Rebellion does not honor the request of “do not track” signals sent by your browser when you visit the Site. Additionally, Rhythmic Rebellion does not collect user information about your online activities over time and across different websites, or authorize third parties to do so.

  1. Children’s Privacy

The Rhythmic Rebellion Site it is not intended for users under the age of 13. We do not knowingly or intentionally gather personal data about visitors who are under the age of 13 and we do not allow users on our website who are under the age of thirteen years old. If you are aware of, or suspect that, someone under the age of 13 is using the Rhythmic Rebellion Site without permission, please notify us immediately by contacting us at support@rhythmic-rebellion.com. If we suspect that, or you are reported, as being in violation of our age policy, we may freeze your account and require that you submit satisfactory proof of age before you may continue using our service.

  1. How We Use Your Personal Information

The personal information you provide to us will allow us to communicate with you and provide the Platform to you, depending on the aspects of the Platform for which you register. We primarily use the personal information you provide and any general information we receive from you to:

  • Create and manage your account
  • Process your orders and for billing purposes
  • Personalize your customer experience
  • Provide customer service, whether it’s responding to a request or following up on an order
  • Improve our services and the interactions you have with our Site
  • Market products and services that may be of interest to you-- for instance, we may add you to our email list and newsletter
  • Detect fraud, including fraudulent payments and use of our Platform
  • Comply with and enforce applicable legal requirements, relevant industry standards and our policies

We keep track of your interactions with us, including but not limited to your activity within the Platform. Except as set forth in this Privacy Policy, or unless we have your consent, we will not share your personal information with any person or entity other than those affiliated with us, entities acting on our behalf, and relevant third parties such as those needed to collect and maintain our servers and perform technology and related services.

We may use your personal information with non-personal information that we have collected in a manner such that the end-product does not personally identify you or any other user of the Platform. We may make your personal information non-personally identifiable by either combining it with information about other users (aggregating your personal information with information about other users), or by removing characteristics (such as your name or email address) that make the information personally identifiable. This process is known as de-personalizing your information. You grant us a royalty-free, worldwide, perpetual, irrevocable and fully transferable right and license to use your personal information in connection with the creation and development of analytical and statistical analysis tools relating to the use of the customer data we collect in providing the Platform (the “Analytical Data”). We are expressly authorized to make any commercial use of the Analytical Data, including without limitation, sharing the Analytical Data with third parties, provided that we do not sell, trade, or otherwise transfer from us any part of the Analytical Data that personally identifies any Platform users.

  1. How We Share Your Information

We use your personal information to provide the Platform to you, deliver products and services you request, complete transactions, handle your customer service questions or issues and send communications to you about promotions, updates, or special offers from Rhythmic Rebellion that may be of interest to you. The personal information uploaded by you through the Platform will be shared only with authorized persons to whom you specifically grant access. We may also use your depersonalized personal information to provide analyses of our users in the aggregate (including Analytical Data subject to the terms of this Privacy Policy) to prospective partners and other third parties. We will also share the personal information we collect from you under the following circumstances, and you expressly authorize us to share your information as follows:

  • Artists. When you purchase merchandise on one of our Artist Sites, we collect information from you that may be shared with our artists, including, your: name, shipping address, email address, and purchase history.  
  • Protection of rights. We will share personal information if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is appropriate to enforce our Terms of Use for the Platform, including any investigation of potential violations thereof, (iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the Platform, or (iv) such action is appropriate to protect the rights, property or safety of Rhythmic Rebellion, its employees, users of the Platform or others.
  • Platform Providers. We may share your personal information with service providers (including our affiliates that provide services on our behalf) that we engage for the purpose of processing information on our and your behalf. For example, we utilize payment processors.  Additionally, we may partner with other companies to process, analyze, and/or store data, including, but not limited to, Analytical Data. While providing services for us, these companies may access your personal information. To the extent applicable, we require these entities to comply with this Privacy Policy and appropriate confidentiality and security measures.
  • Asset transfers. If we become involved in a merger, acquisition or other transaction involving the sale of some or all of Rhythmic Rebellion’s assets, user information, including personal information collected from you through your use of the Platform, could be included in the transferred assets. Should such an event occur, we will use reasonable means to notify you through email and/or a prominent notice on the Site.

  1. Third-Party Links

The Platform may contain direct links to websites operated by our partners and other entities. These third-party websites may collect information about you when you visit them or otherwise communicate with them. This Privacy Policy does not cover the information practices of third-party websites linked to the Site or accessible through the Platform. Although we encourage such third parties to adopt and follow their own privacy policies, we are not responsible for their collection and use of your personal information. You should refer to the privacy policies and statements of other websites or contact the respective webmasters of those websites to obtain information regarding their information collection, use and disclosure policies.

  1. Your Rights and Choices Regarding Your Information

Control of Your Information

After creating an account through the Platform, you may update or delete your personal information or modify your account preferences for the Platform by accessing the account interface provided through the Platform. Please note that if you disable your account, we will keep your contact information on file, and may retain other account information for a reasonable period of time afterward for the purpose of internal account management and fraud prevention.

Communication Settings

You can control what information is share with our artists through the Communication Settings tab of your profile.  For example, you may choose to share personal data (for example, your email address) with artists who may want to directly send you news or promotional offers. You have the option to change your mind and withdraw your consent at any time. Please note, however, if you purchase merchandise through an Artist Site, this information, along with your shipping address, may be shared with the artist.  

Your Choice to Opt-Out

If you no longer want to receive our newsletter, emails or other marketing communications, you may unsubscribe by following the “unsubscribe” link at the bottom of our emails or by writing to us at support@rhythmic-rebellion.com. Please note that you cannot unsubscribe from certain correspondence from us, including messages relating directly to your account or orders placed through the Platform.

Deactivating Your Account

You may deactivate your account at any time by contacting us at  support@rhythmic-rebellion.com. When submitting your request, please let us know what led you to deactivate your account. Your feedback is greatly appreciated, and will help us to better accommodate members of the community.

  1. How We Store and Safeguard Your Information

We care about protecting your information, so we employ physical, technical, and administrative safeguards designed to help keep it safe, including encryption and techniques to reduce the ability to identify an individual in some cases. Since no data transmission over the Internet or other network can be guaranteed to be 100% secure, we cannot and do not guarantee the security of any information you transmit on or through our websites or a mobile app (if available). Additionally, when you communicate with customer service via email or chat, we ask that you not share sensitive information via these communication channels.

When you register on one of our websites, you will need to set up a password to access your information on our site. If you want to change your password, click on “Login In” from any page on the website, and you can access, correct, or update your choices and settings from within your account. Note that we don’t ask customers to confirm account or credit card details by email – if you receive an email claiming to be from us and asking for this information, do not respond.

  1. International Transfers and Processing

Please be aware that your information may be transferred to and maintained on servers or databases located outside your state, province, or country. If you are located outside of the United States, please be advised that we process and store Personal Information in the United States. The laws in the United States may not be as protective of your privacy as those in your location. By using our websites, you are agreeing to the collection, use, transfer, and disclosure of your Personal Information, browsing information, and that communications will be governed by the applicable laws in the United States.

  1. Changes to this Privacy Policy

We may change this Privacy Policy from time to time. Laws, regulations, and industry standards evolve, which may make those changes necessary, or we may make changes to our services or business. We will post the changes to this page and encourage you to review our Privacy Policy to stay informed. If we make changes that materially alter your privacy rights, we will provide additional notice, such as via email or through the Platforms. If you disagree with the changes to this Privacy Policy, you should deactivate your account and cease use of our Platforms
