Rhythmic Rebellion always endeavors to protect and respect your privacy. We offer a virtual online music industry where users can create songs and collaborate on musical recordings and have their product promoted, distributed and performed using the various tools and services available on our website (collectively, our “Applications”).

In this Privacy Policy (together with our Terms of Service and other documents related to it), we describe how we collect, collate, use and disclose information obtained from the Applications regarding you and as well as other visitors. In this document, we will refer to you the user as “you” and “your.”

By visiting, viewing, downloading, listening to, and/or using any of our Applications, you agree that your personal information will be used and handled as we describe in this Privacy Policy and that you consent to such use. IF YOU DO NOT AGREE AND CONSENT TO THE TERMS CONTAINED IN THIS PRIVACY POLICY, PLEASE STOP USING THE APPLICATION IMMEDIATELY.

 

ABOUT US

The Site and Applications are operated by Patron Empowerment LLC (“Patron”), PO BOX ****, Fort Valley, GA 30103, USA. As used in this Privacy Policy, Patron includes the parent company, Rhythmic Rebellion and all other entities Patron controls, is controlled by or is under common control with, including subsidiaries, joint ventures or other entities in whom Patron and/or Rhythmic Rebellion has a substantial ownership interest (herein “Rhythmic Rebellion” or collectively from time to time as “we,” “us” and/or “our”).

 

TYPES OF INFORMATION COLLECTED & HOW IT IS USED

There are three types of information we may collect: input you give us, information we collect and information provided by third parties. We may use this information separately (as provided or obtained) or we may aggregate and combine it with other information obtained using one of the other methods, or from third parties.

 

User Input: When you sign up with us or use our Applications, certain areas and features may require registration either directly or through a social media such as, but not limited to, Google Plus, Twitter, Facebook Connect or Open ID.  All of the methods require user input or permission to accumulate, purchase, redeem points, virtual items and rewards, and to post any user content. To register, you will need to create an account with us by providing certain types of information, including, but not limited to, your first and last name, a valid email address, and certain other types of demographic information. Other types of information that you may input includes, but is not limited to, the following:

·Forms filled out by you;

·Correspondence with us by phone, e-mail, SMS or otherwise;

·Registration;

·Subscriptions or orders;

·Participation in discussion boards or other social media functions;

·Entering a competition, promotion or survey;

·Reporting a problem or requesting support.

 

 

The information you provide may be used in the following ways:

·To help us respond to your queries;

·To carry out our obligations arising from any contracts between you and us and to provide you with the information, products and services that you request from us;

·To provide you with information about other goods and services we offer that are similar to those that you have already purchased or inquired about;

·To provide you, or permit selected third parties to provide you, with information about goods or services we feel may interest you. If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, simply log in to your account and click the appropriate “opt-out” box available in your user dashboard to disable the information type you no longer wish to receive;

·To notify you about changes to the Applications or our Privacy Policy and/or Terms of Service;

·To manage your access;

·To allow you to interact, for example by posting comments;

·To allow you to share information on third party social media platforms; and/or

·To comply with legal and regulatory requirements.

Information We Collect about You: When you visit our website or use our Applications, we may automatically collect certain types of information about you or the devices you use to download or connect to the Applications. To do this, we place small amounts of alphanumeric data on your device, called “cookies” (including Flash cookies) and “tracking software” that is designed to track information about you and your use of our Applications. This type of information includes the following:

·Technical information, including the types of device used (including manufacturer and model), its IP address or unique device identifier, login information, geolocation, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;

·Information about your visit, including the full URL clickstream to, through and from our site (including date and time);

·Pages you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

·Third party partners may collect personal information about your online activities over time and across third party websites or online services through your use of the Applications over which we have no control.

 

The information we collect directly may be used in the following ways:

·To use the date in any of the ways indicated in regard to User Input above;

·To administer our site and/or Applications for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

·To improve our site and/or Applications to ensure that content is presented in the most effective manner for you and for your computer;

·To allow you to participate in interactive features of the Applications, when you choose to do so;

·As part of our efforts to keep our Applications safe and secure;

·To measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you; and/or

·To make suggestions and recommendations to you and other users of our site about goods or services that may interest you or them.

Information We Collect about You from Other Sources and Third Parties, including, but not limited to, Facebook: We may also receive and collect certain types of information about you from other websites affiliated with Rhythmic Rebellion as well as from third party affiliated companies, including the items of information mentioned in the previous two sections, as well as the following:

·Information shared internally between Rhythmic Rebellion companies;

·Analytics and other data collected by third parties with whom Rhythmic Rebellion works closely;

·Information received from subcontractors, search information providers, credit reference agencies, and/or any other third party with whom you may have granted access to your information;

·If you log into our Applications through Facebook, your basic profile information, including but not limited to your name, profile picture, gender, news feed, timeline, networks, user ID, list of friends, DOB, email address, posts to your wall, and other information you have identified as “public” on Facebook, Twitter or Google, even when you are not using your social media account. Rhythmic Rebellion does not control the profile information collected about you through social media networks. For information about how these social media networks may disclose your information, including any information you make public, please consult the privacy policies posted on those social media websites. Even though we collect and store such information, we have no control over how social media sites use or disclose the personal information you provide to it.

·In either of the above-mentioned cases, this Privacy Policy serves to notify you, and the third party will have notified you, of the right to share such information when such information was originally collected.

 

The information obtained from third parties may be used in the following ways:

·To combine with information, collate and aggregate with the information you give to us and information we collect about you.

·We may use this information and the combined information for any purposes set out above (depending on the types of information we receive).

Information We DO NOT Collect about You: We do not collect the following types of personal information as defined in the Nevada Revised Data Security law, Section 603A.040:

·Social security number;

·Driver’s license number, driver authorization card number or identification car number;

·Account number, credit card number or debit card number, in combination with any required security code, access code or password that would permit access to the person’s financial account;

·A medical identification number or a health insurance identification number;

·A user name, unique identifier of electronic mail address in combination with a password, access code or security question and answer that would permit access to an online account; and

·Information about your online activities over time and across third party (non-Rhythmic Rebellion Company) websites.

SPECIAL NOTE TO EUROPEAN CONSUMERS: The EU and other countries may use a specific opt-in standard for certain types of data collection that differ from the ones described in this policy. If you are a resident of any such country, you must either discontinue using this site or our Applications or otherwise authorize consent immediately using this CONSENT FORM.

 

In compliance with the European Union’s General Data Protection Regulation, Rhythmic Rebellion uses the data it collects from users in the following ways:

  • Our need for data on fans revolves around us wanting to give a good experience to the fan by offering music they are interested in and informing them of events in their area
  • In conjunction with our advertisers we want to offer products and services that meet their taste and needs

  • Friend connections
  • Products and services they are interested in
  • Music Creators
  • Data Collected
  • The same data that was collected for fans is also collected for music creators (i.e. – first name, date of birth, etc.)
  • Last name
  • SSN and Mailing Address
  • Why This Data Is Collected
  • In the United States (and in several other countries) before payments can be made from Rhythmic Rebellion to the music creator we are required to have their SSN and mailing address

 

HOW WE DISCLOSE YOUR INFORMATION

We may share your personal information with any Rhythmic Rebellion Company, and with selected third parties including, but not limited to:

Business partners (including social media networks), suppliers and sub-contractors for the performance of any contract we enter into with them or you;

Aggregate or anonymized data to advertisers and advertising networks that require the data to select and serve relevant advertisements to you and others. We may also use such aggregate information to help advertisers reach the kind of audience they want to target. We may make use of the personal data we have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience;

Analytics and search engine providers that assist us in the improvement and optimization of our Applications;

Both your and our social media friends as well as other users of our Applications; and/or

In response to a legal process that requires our disclosure of such information.

 

We may also disclose your personal information to third parties in the following instances:

In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;

If any of the Rhythmic Rebellion companies or substantially all of their assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets;

If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of Rhythmic Rebellion, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction; and/or

To any other third party with your consent to do so.

 

HOW WE STORE YOUR INFORMATION

All the information you provide may be stored on our servers (including cloud-based server technology), or transferred or accessed by entities around the world as described in this policy, including but not limited to any Rhythmic Rebellion company or affiliate, using commercially reasonable standards and precautions. By submitting your information, you agree to this transfer, storing or processing and we agree to take all reasonably necessary steps to ensure that your data is treated securely and in accordance with this privacy policy.

 

The security of your personal information is important to us. We have put in place appropriate technical and organizational procedure to safeguard the information we collect. All information you provide to us is stored on secure servers. Any payment transactions will be encrypted using SSL technology. If we provide and/or you choose a password which enables you to access certain parts of our Applications, you are responsible for keeping this password confidential and we ask you not to share a password with anyone.

 

Unfortunately, no security measures can guarantee 100% security and you should be aware that transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data per industry standards, we cannot guarantee the security of your data transmitted over the Internet and any such transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

Notwithstanding anything in this section to the contrary, Rhythmic Rebellion complies fully with Georgia’s Personal Identity Protection Act (the “GPIPA”), specifically Sections O.C.G.A. 10-1-910 through 10-1-912, as well as the current version of the PCI Data Security Standard as established by the PCI Security Standard Council by: using reasonably security measures to protect your information from unauthorized access; complying with any notice requirements established by the GPIPA; and ensuring the complete destruction of such information when it decides in its discretion that it will no longer maintain such information.

 

OUR TRACKING METHODOLOGIES

As indicated above, we and our affiliates, analytics and service providers use passive and active technologies such as cookies, web beacons, pixel tags, fingerprinting and scripts (“Cookies”). These Cookies may be limited to one session only, or they may be persistent in that they remain on your device after you have closed the Applications. These technologies are used in analyzing trends, administering the Applications, remembering preferences, tracking users’ movements around the Applications and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

We also use Local Storage Objects (LSOs) such as HTML5 or Flash to store content information and preferences. Third parties with whom we partner to provide certain features on our Applications or to display advertising based upon your Web browsing activity use LSOs such as HTML5 or Flash to collect and store information. Various browsers may offer their own management tools for removing and/or disabling HTML5 or LSO’s.

We may also participate in online behavioral advertising methodologies and algorithms such as, without limitation, Google Adwords, Ad Roll and AppNexus.

 

USER GENERATED CONTENT

We may permit users to submit their own content to our website and Applications including, without limitation, pictures, reviews, comments and other text. We are not responsible for the privacy of any information that you choose to submit to use or through any public forum maintained by us or a third party, such as a blog, or for the accuracy of any information contained in those postings. Any information that you disclose in this manner becomes public information and we cannot prevent such information from being used in a manner that may violate this Privacy Policy, the law, or your personal privacy preferences.

 

THIRD PARTY LINKS

Our Applications or other Rhythmic Rebellion websites may, from time to time, contain links to and from third party website of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these sites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these third-party websites.

 

CHILDREN UNDER THE AGE OF 13

Rhythmic Rebellion fully complies with the Children’s Online Privacy Protection Act. The Applications are not directed toward children under 13 years of age nor does Rhythmic Rebellion knowingly collect information from children under 13. If you are under 13 years of age, you are not permitted to submit any personally identifiable information to Rhythmic Rebellion. If we discover that a child under the age of 13 has provided us with any information, we will immediately delete such information from our servers.

 

YOUR RIGHTS

You are responsible for keeping the information you supply to us current and up-to-date. You may update your information through the Applications themselves, or by contacting us at the address listed below.

If your personal information changes, or if you no longer desire to use our Applications, you may correct, update, amend, delete/remove it by making the change on our member information page or by contacting us at address listed below.

 

We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.  Notwithstanding anything in this section to the contrary, solely for users who also execute the Creative Supplement to the Master Terms & Conditions, certain provided information and data, including without limitation Songs and Recordings, will be retained longer in accordance with the terms and provisions of that document.

If you wish to subscribe to any newsletter or playlists, we will use your name and email address to for that purpose. We may also send periodic promotional or informational emails to you about Rhythmic Rebellion’s or our affiliates’ products or services. Out of respect for your privacy, you may choose to stop receiving any newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page, or by contacting us at the contact information listed below. To adjust the information, we receive about you from social media networks, you must change your account settings directly through each of those social media networks.

Where provided under applicable law, you may have the right to ask us for a list of your personal data we share with third parties and information regarding those third parties, if the third parties use the personal data for their direct marketing purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. You can also exercise your right at any time by contacting us at address listed below.

 

SPECIAL NOTICE TO CALIFORNIA CONSUMERS: California residents may request a list of certain third parties to which we have disclosed certain personal information about you for the third party’s own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for our response to you. We will respond to you within thirty (30) days. You may request this information in writing by contacting us at address listed below.

 

SPECIAL NOTICE TO EUROPEAN CONSUMERS: European Union and European Economic Area residents may request to withdrawal their consent for Rhythmic Rebellion to use and store certain personal information. Such request may be sent to the email address below and will be processed in a timely manner.

 

THIRD PARTY ADVERTISEMENT NETWORKS

We may use third parties to assist us in advertising our Applications as well as other Rhythmic Rebellion websites and services, and we participate in third-party ad networks that may display advertisements on other websites based on your download and/or us of our Applications as well as visits to our websites. This enables us and these third parties to target advertisements by displaying ads for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), LSOs and other technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party’s specific privacy policy, not this one. We may provide these third-party advertisers with information about your usage of our Applications or other websites, as well as aggregate or non-personal information about those who use our Applications, as well as visit to our other websites or use other services we provide. You may opt-out of many third-party ad networks, including those operated by members of the Network Advertising Initiative (“NAI”) and the Digital Advertising Alliance (“DAA”).

CHANGES TO THIS PRIVACY POLICY

This Privacy Policy is effective as of July 1, 2017. Any material changes we may make to our privacy policy in the future will be posted on this page prior to the change becoming effective and notify you through the Applications or, where appropriate, by e-mail. Please check back frequently to see any updates or changes to our privacy policy. These changes will become effective upon obtaining your consent, if necessary, as required under local law. If you do not agree or consent to these updates or changes, do not continue to use the Applications.

 

CONTROLLING LAW AND JURISDICTION

This Privacy Policy is intended to comply with the guideline of the United States’ federal law as well as the Federal Trade Commission requirements (including certain provisions of the Gramm-Leach-Bliley Act and COPPA), the GPIPA, and all European directives (including the EU Privacy Directive, the FTC/EU Safe Harbor and the May 11, 2011 Cookie Rule). Any action related thereto will be governed by the laws of the State of Nevada without regard to its conflict of laws provisions. Except as otherwise provided in the “Choice of Law, Mandatory Arbitration and Venue” Section in our Terms and Conditions, the exclusive jurisdiction and venue of any action with respect to the subject matter related to your use of our Applications will be the state and federal courts located in Fulton County, Georgia, including without limitation the U.S.D.C. for the North District of Georgia, and each of the parties hereto waives any objection to jurisdiction and venue in such courts.
